Because of the increasing number of facilities in the public right-of-way, the city has adopted a Right-of-Way Procedures Manual in order to guide and manage the use of the public right-of-way. This manual is intended to provide technical criteria and details necessary to implement the provisions of the Right-of-Way Ordinance.
The ordinance states that the Public Works Director or his designee is authorized to administer and enforce the provisions of the ordinance, and to promulgate regulations including, but not limited to, engineering, technical and other criteria and standards.
Prior to registration, a public service provider must be either a certificated telecommunications provider under Chapter 283 of the Texas Local Government Code or have a franchise or license agreement with the city.
Prior to obtaining a permit to perform construction within the public right-of-way, a public service provider must first register with the City of McKinney.
